If you did not replace a fence, or build a fence, an old survey is fully acceptable. However, if you replaced a fence, even if you used the same fence line, and many of the same posts, it "requires" a new survey. Not sure how accurate the info is, but the last property I sold, I had replaced the fence. Used almost all of the same posts, as they were good and secure. Mostly was restringing new wire. When I sold, was told that, because of the fence situation, had to have a new survey.

I'm about convinced they make up the rules as they go along.
I was told if the fence was considered the line, and has been there at least 10 years, it would still be considered the line even if survey said different.

My farm property was once 120 acres. 40 was sold to the adjacent farm many years prior. There was a fence that was declared the line. The fence was NOT straight. sections of it went tree to tree and zig zagged. Ownership chanced twice. Latest owner wanted to put up new fence and straighten the line. We both agreed the new fence would be the new line.

The owner hired a guy to clear the brush and old fence out. He asked if he could cut any dead trees on my side that could fall on his new fence. I told him as long as he did not take big trees, he could clear a lane on my side, which he did. Fencing company stretched a line from the corner posts at each end. Where they found a tree was causing the line to not run straight, the line was moved to the other side of the tree and restretched. This was done multiple times until a straight line was established for the new fence. Some areas I lost a few feet and others I gained a few feet. I would say no more than 10' at the most. Mostly around 5' gained or lost.

The fencing company asked me if they could straddle the line to pound posts in and string wire. I told them they could as long as they did not leave any trash on my property. The guy said one land owner made him stay off and he had to back up to each post position and then pound the post in.

There was large cherry tree the old fence zigged to, that is now the neighbor's, but I ended up with a large walnut tree and cherry tree that had been several feet on his side of the fence. We are both satisfied with the results. Plus I can now drive along my side of the fence

Now if that is the change definition, then I did make a change after all and a new survey should have been required. All involved in the sale knew about the fence repair/replacement, of course.

So easy to open a can of worms. Our house, shed & shop are centered on 2 lots. We knew we were going to have to add an additional septic system for the house addition (lot #1) and had planned to put it on lot#2 with a planned 1/2 bath in the shop (lot#2). Had perk hole dug & tested when unexpected medical bills ate the funds. Fast forward 10 years. Now the county will not permit septics across lot lines. Their solution was to get a new survey and easement stuff from all entities. Cost would have been over $10,000 - more than the cost of the septic. And the kicker would be that there was a good chance the house would be reassessed and our over-65 tax "value freeze" would be drastically increased. No way, Jose. Put 2nd septic on lot#1 and no septic to the shop.

Went ahead and made the trip to the state track meet. The kids ran and we watched, IN THE RAIN. It was a really cold and nasty day.

The girls took 2nd place in the 4 x 200 Relay.

Glad to be back home now, dry and warm. But another 1/2" and it's still raining.

    Interesting Day

Things of importance which I achieved today......

    1. Had a nice phone conversation with Levi late this afternoon. He sounded just like he does on the video! We had a nice discussion and covered many topics.

    2. Got Hospice involved with Mom2 and Dad2 to help care for their sister in law. She's 97 and things have changed dramatically in the last month. It took some convincing and my spectacular sales skills, but I convinced them to first allow help and let me get it for them.

    3. Neighbors lawn seeded today after trying for the last 5 weeks. Had it slit seeded by a local landscape company and as they were finishing, SURPRISE, it started to rain.

    4. I mowed 5 acres with the RC2048. Bought shook my spine loose on the bumps. I think I might add air ride seat base......

    5. Used my new DeWalt Grease Gun. That is the way to grease things....can't believe I waited as long as I did to buy one of these.

    6. I found these, but not before the mower did.....

    7. This arrived which is the free gift for purchasing the DeWalt Grease gun kit at the spectacular price of $199......

    Well of course he did.

The cordless grease guns are incredible. Just incredible. Now that I think about it I might just bring mine to show BigJim and get his new thingy greased up.
