I just received notice that I am a member of a class action law suite against Morning Song wild bird feed.
In 2006 & 2007 I purchased Morning Song bird food from Orschein.
The claim is that there was pesticides applied to the bird food. I do not know what the problem was with that, as we did not have any dead birds around.
It states that I will receive a full refund for the bird food I purchased between November 2005 & May of 2008.
The information contained a list of the bird food I purchased during that time.
The total settlement of the class action is $85,000,000. The Attorney fees can be up to $450,000 plus $10,000 per class member.
So if someone purchased a $10 bag of bird food, the purchaser will get $10 & the attorney gets at least $10,000.

This is another lottery win for attorneys.

My question is how did they know you bought the seed over 10 years ago? and who is they? :hide:

I have received a couple of checks for class action suits, the one I remember was for automotive light bulbs. I got a rebate is how they know I bought them. I guess the were not as bright as they made them out to be. The check was for something around $12. When you get the check, it almost looks like junk mail too. I wonder how many people just threw them out.

I’m familiar with this case.

In short as to “how do they know” - TSC and a few other retailers tracked purchases via their loyalty clubs...if you bought it there, you automatically qualify for the refund.

If you bought and did not use loyalty card or bought at a non tracking retailer, you need to fill out the form to claim the refund. As with most class actions, expect an appeal and know it may be years until final disbursements.

As to customers getting dimes and attorneys getting dollars...I’ll simply say this case was very generous IMHO. Consumers get 100% refund on the purchase price - and can claim up to $100 without proof. Seems pretty good to me - wish every lawsuit was as generous. Of course there’s a good chance for pro/rata disbursements as the claims may exceed the settlement fund. Still if you overspent in high grade bird food - a 100% refund of price paid is nice to me.

Oh the 10k per class member is for “name” litigants. I/E the named plaintiffs and their counsel - the people who filed the suit to begin with and got it certified as a class. If there are a 100.000 class members- the 10k applies only to the few named litigants- not each class member getting a few dollars.

The attorneys audited Orschein, Tractor Supply, Sams Club, PetSmart, Menards & Farm & Home as part of the discovery process.

That is kind of scary that records of my life's purchases as simple as bird seed can be tracked down! I need a tinfoil hat for sure now.
